WHO NEEDS THIS LETTER?

This letter is required for a person who has been appointed as a Lifting Machine Operator in the workplace. This permits the person to operate the type of lifting machinery for which they have been trained on. They will be responsible for operating the lifting machinery correctly and safely and for performing regular checks of the lifting machinery to ensure it is in good condition and safe to use.

WHAT IS THIS LETTER FOR?

This letter shows that a Lifting Machine Operator has been appointed for operating lifting equipment in a particular area of the workplace, according to the requirements of the OHS Act. The letter allows these persons to operate the lifting machinery under the authority of the 16(2).

WHY IS THIS LETTER IMPORTANT?

This letter shows that a responsible person has been appointed to operate lifting equipment in a particular area of the workplace. This provides evidence to an inspector that a basic structure is in place to ensure that lifting equipment in a particular area is operated by approved persons who are competent to do so. This letter is relevant under section 18 of the Driven Machinery Regulations of the OHS Act and its availability shows that the employer is taking steps to comply with these Regulations in respects of ensuring all lifting equipment in the workplace is operated correctly and safely. 

VALIDITY

This letter needs to be signed by the 16(2) (as the appointer) and by the appointee, dated and kept on record where it can be accessible to an inspector. A time period must be included for the appointment. Each appointee must have the relevant accredited training in order to be competent to perform these duties.
